Can I Sue Amazon for My Injuries?
When you are injured in an Amazon delivery truck accident, you may wonder if you can file a lawsuit against Amazon for damages. Unfortunately, Amazon generally shields itself from direct liability for accidents because its drivers are not Amazon employees. Instead, most Amazon drivers fall into one of two categories:
- Amazon Flex drivers. Amazon Flex is Amazon’s platform for independent contractors. These drivers are not employees. More so, they use their personal vehicles to deliver packages.
- Delivery Service Provider (DSP) drivers. DSPs are independent third-party businesses that Amazon contracts with to deliver its packages. While DSP drivers drive Amazon-branded trucks, they are employees of the DSP and not Amazon.
Amazon’s business model of not hiring drivers as employees makes it difficult for injury victims to hold Amazon accountable as a liable party.
Who Is Liable for My Damages if Not Amazon?
Holding Amazon directly liable for your injuries can be challenging because its drivers are mainly independent contractors or DSP drivers. Even so, you may have other avenues to pursue compensation.
Amazon Flex Drivers
You may still be able to file a claim against Amazon’s commercial auto insurance policy if the driver that hit you was an Amazon Flex driver. Amazon provides its Amazon Flex drivers with up to $1 million in commercial auto liability coverage. This policy covers injury and damage to third parties caused by its Amazon Flex drivers. However, it only applies if the following circumstances exist:
- The Amazon Flex driver has an active personal auto insurance policy that complies with their local laws
- The accident occurred while the Amazon Flex driver was actively driving and delivering for Amazon
Delivery Service Partner (DSP) Drivers
If the at-fault driver is employed by a DSP, the DSP should have commercial auto insurance for its drivers. You may be able to file a claim against the DSP’s commercial auto insurance for damages.
If the driver does not have commercial auto insurance coverage, you may be able to recover compensation from the delivery driver’s personal auto insurance. You may also be able to file a claim with your own uninsured or underinsured motorist coverage if you have it.
We recommend reaching out to an experienced Amazon truck accident attorney to help you determine who is liable for your losses. In many cases, more than one party may share liability. Our team can investigate all potential avenues of compensation to maximize the potential compensation you need and deserve for your damages.

What Compensation Can I Get in an Amazon Truck Accident Case?
Have you been injured in an accident with an Amazon truck? If so, you may be entitled to compensation, also called damages, for your losses. Damages often fall into two main categories: economic and non-economic.
Economic Damages
Economic damages are the monetary losses you incurred as a result of the accident. They are typically easier to calculate because there is usually a verifiable dollar amount associated with these losses. Economic damages generally include the following:
- Past and future medical expenses. You can seek compensation for all medical costs incurred due to the accident. This includes costs for emergency care, hospital stays, surgeries, medication, doctor’s visits, and other treatments. If you require ongoing care, like rehabilitation, you can also seek compensation for your expected future costs.
- Lost wages. If your injuries have prevented you from working for a period of time, you can seek reimbursement for the wages and benefits you would have earned.
- Loss of future earning capacity. Serious or permanent injuries may limit your ability to return to work or work in the same capacity. You can pursue compensation for the expected income you would have been able to earn had the accident not occurred.
- Property damage. You can seek reimbursement for the costs incurred to repair or replace your vehicle after the accident. If any other personal property was damaged or destroyed in the accident, you can also seek reimbursement for these items.
Non-Economic Damages
Unlike economic damages, non-economic damages are non-monetary losses you incurred due to the accident. Calculating non-economic damages can be more challenging because it requires assigning a monetary value to experiences like physical pain and life changes.
However, they are just as important because they aim to compensate you for the physical, emotional, and psychological consequences of the accident. Examples of non-economic damages include:
- Pain and suffering. Pain and suffering encompass the physical pain and emotional distress caused by the accident. Examples of emotional and psychological impacts may include anxiety, depression, and post-traumatic stress disorder (PTSD).
- Loss of quality of life. If your daily life has negatively changed, you can seek compensation for this loss. For example, if you can no longer participate in hobbies or social activities you once enjoyed.
- Disability or disfigurement. Have your injuries resulted in permanent disability or disfigurement? If so, you face ongoing limitations and a lower standard of living than before the accident. You should be compensated for these losses.

I can't say how great it feels to have a team of attorneys working to help with my truck accident. It's such a relief knowing I can leave all the back and forth with the insurance people to them and know they will do a great job.
Last week my check came in the mail and it was a moment of pure relief knowing I've been able to get past this chapter of my life and get back to being the best mom and partner I can be. Bless you.
I wanted to get in touch with an attorney who could help with my case after I was hit from behind on the freeway. This team picked up my call right away and gave me all the information the insurance didn't want me knowing. I'm able to focus on the doctor's therapy while the lawyers work on my case.
